By accessing or using The Gap Strategist™ application ("Service"), operated by Cindy Keyes ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

The Gap Strategist™ provides AI-powered life and career coaching tools, including situation analysis, personalized recommendations, and an interactive workbook based on the methodology developed by Cindy Keyes. The Service helps users navigate challenges in career, relationships, family, and personal growth. It includes both free and premium subscription tiers with varying levels of access to features.

3. AI Coaching Disclaimer

IMPORTANT: Please read this section carefully.

The AI Coach feature provides recommendations and suggestions based on the personal experiences, research, and methodology of Cindy Keyes, The Gap Strategist™, as outlined in The Gap Strategy. These recommendations are intended for informational and educational purposes only.

The AI coaching suggestions are NOT:

  • Professional legal, financial, or career counseling advice
  • A substitute for consultation with qualified professionals
  • Guaranteed to produce specific outcomes or results
  • Applicable to every situation or individual circumstance

You acknowledge and agree that:

  • All recommendations are based on general principles and may not apply to your specific situation
  • You are solely responsible for any decisions you make based on the AI coaching suggestions
  • Results may vary significantly depending on individual circumstances, workplace culture, relationship dynamics, and other factors
  • You should use your own judgment and seek professional advice when appropriate

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CINDY KEYES, THE GAP STRATEGY™, AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of employment or career opportunities
  • Damage to professional relationships or reputation
  • Financial losses resulting from decisions made based on AI recommendations
  • Emotional distress or personal injury
  • Any other damages arising from your use of the Service

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

5. User Responsibilities

By using the Service, you agree to:

  • Provide accurate information when describing your situations
  • Use the Service for lawful purposes only
  • Not rely solely on AI recommendations for critical career or life decisions
  • Maintain the confidentiality of your account credentials
  • Not share, resell, or redistribute the Service content without authorization

6. Intellectual Property

The Gap Strategy, including all content, methodology, Gap Laws, and associated materials, are the intellectual property of Cindy Keyes. Users are granted a limited, non-exclusive license to use the Service for personal, non-commercial purposes. Reproduction, distribution, or commercial use of any content without express written permission is prohibited.

7. Subscription and Billing

Premium subscriptions are billed on a recurring basis (monthly or annually) until cancelled. By subscribing, you authorize us to charge your payment method automatically. You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period.

We offer a 14-day free trial for new premium subscribers. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription.

8. Privacy

Your use of the Service is also governed by our Privacy Policy. We collect and process your personal information, including situations you submit, to provide the Service. We are committed to protecting your privacy and will not share your personal information with third parties except as necessary to provide the Service or as required by law.

9. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of significant changes via email or through the Service. Your continued use of the Service after such modifications constitutes your acceptance of the updated terms.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of the Service shall be resolved through binding arbitration.
